General terms and conditions of sale

RAFIN Events pop-up restaurant at the Château d’Enghien

English version

1 Organiser and acceptance

  • RAFIN Events is organised by ARTHINVEST SRL. VAT: BE0417781968. Billing address: Av. de Brouckère 44-46, 1160 Auderghem, Belgium. Contact: hello@rafin.be. Website: www.rafin.be.
  • These terms apply to bookings for the pop-up restaurant at the Château d’Enghien. They are available before booking and must be accepted when placing the order.

2 Bookings and proceedings

  • All bookings are made exclusively online at www.rafin.be. For a specific question or a group of more than 10 people, write to hello@rafin.be. After this exchange, the booking must also be completed online; an e-mail does not constitute a booking.
  • The booking is confirmed once the payment requested online has been made and the confirmation has been sent. It is valid only for the confirmed date, time, package and number of guests.
  • The evening buffet includes raclette every week and winter specialities that vary from week to week. All dishes announced in the package are all-you-can-eat throughout the evening, until the end of service stated when booking. Drinks are not included.
  • The menu, times and any brunch packages are specified on the website before booking. The all-you-can-eat package is reserved for consumption on site by guests who have paid for their meal.
  • Allergies or dietary requirements must be reported before booking to hello@rafin.be, so that possible adjustments can be checked. Information on allergens is available from the team.

3 Prices and payment

  • The evening buffet is offered at €49 including VAT per person, all-you-can-eat, excluding drinks. The price of other packages and any supplements are indicated before ordering.
  • The amount of the meal must be paid in full before the event, in accordance with the terms indicated online. Drinks and supplements ordered on site are paid separately, at the prices displayed.
  • Promotional offers apply in accordance with their announced conditions. Discounts cannot be combined, unless otherwise stated.

4 Withdrawal and cancellation by the customer

  • A restaurant booking for a specific date does not benefit from the 14-day right of withdrawal, in accordance with Article VI.53, 12°, of the Belgian Code of Economic Law.
  • Confirmed bookings are non-refundable, non-exchangeable and cannot be modified at the customer’s request, unless the Organiser agrees in writing or mandatory law applies. This rule also applies to no-shows and to reductions in the number of guests.
  • Any exceptional request must be sent to hello@rafin.be. The customer’s statutory rights, in particular in the event of non-performance by the Organiser or recognised force majeure, remain unaffected.

5 Cancellation by the Organiser and force majeure

  • If the Organiser cancels a service, in particular due to an insufficient number of bookings, it will inform customers as soon as possible. The customer chooses between postponement to an available date and a full refund of the cancelled service. No postponement or credit note will be imposed on the customer.
  • If an event of force majeure prevents the meal from taking place, a postponement may be offered. Failing agreement, the sums paid for the service not provided will be refunded without undue delay. No additional compensation is due where the law exempts the Organiser from liability.
  • Bad weather, a fire, a decision by the authorities or a breakdown only constitutes force majeure if the legal conditions are met. An insufficient number of bookings is not a case of force majeure.

6 Rules in the château and liability

  • Smoking is prohibited in the château. Outside food and drinks are not allowed, except with prior agreement, in particular for a medical need or for feeding an infant.
  • Guests must respect the premises, the equipment, the times and the safety instructions. A person whose dangerous or seriously disruptive behaviour justifies it may be refused entry or asked to leave the premises, in compliance with the law.
  • Each guest is liable for any damage they cause, in accordance with the legal rules. The Organiser may claim justified repair costs from the person responsible.
  • Personal belongings remain under the supervision of their owner. The Organiser is not liable for losses, thefts or acts of other guests that are not attributable to it.
  • The Organiser is not liable for delays or interruptions due to an external cause that legally exempts it from liability. If it is impossible to provide the meal, the provisions of Article 5 apply.
  • No clause excludes or limits any liability that cannot legally be excluded or limited, in particular in the event of intentional misconduct, gross negligence or harm to life or physical integrity attributable to the Organiser. The customer’s mandatory rights remain applicable.

7 Photographs and final provisions

  • Photos or videos may be taken during the event. For targeted shots used for promotional purposes, specific prior consent is requested for the shooting and the intended uses. Accepting these terms does not constitute authorisation to use your image. For any request: hello@rafin.be.
  • Booking data are used to manage the order, the payment and the follow-up of the meal, in accordance with the privacy policy made available at the time of booking.
  • Any question or complaint may be sent to hello@rafin.be. Please also report any difficulties to the team on site so that a solution can be found quickly.
  • The applicable version is the one accepted at the time of booking. An update of the terms does not change bookings already confirmed.
  • If a clause is unenforceable, the others remain valid if the contract can continue to exist. Failure to invoke a clause does not constitute a waiver of it.
  • Belgian law applies, subject to the mandatory consumer protections. The competent courts are determined by the applicable legal rules.
